California Proposition 45 would offer qualifying “essential” projects new procedures for environmental review, permitting and court challenges. Applicants could choose those procedures or existing ones. The November 3 vote is pending.
The Legislative Analyst estimates initial annual government costs in the high tens of millions of dollars, potentially exceeding $100 million, partly offset by fees. Long-term net fiscal effects could be positive or negative. Proponents’ separate funded-study estimates are advocacy claims, not the neutral fiscal forecast.
Legislative amendments would require a two-thirds vote and consistency with the measure’s purposes. Data-center eligibility is disputed; the proposal should not be described as blanket approval for private developments.
Our read: Project-specific eligibility and remaining permits matter. A proposed deadline is not an existing entitlement or assurance of construction.
